To our employer clients…

By October 1, 2013, all employers are required to provide a written notification to all employees about the availability of the new Health Insurance Marketplace (formerly called Exchanges) mandated by the Affordable Care Act.  Notice must be provided whether or not you provide health insurance to your employees, and regardless of the number of employees.

For employees hired prior to October 1, notice must be provided by October 1.  For all employees hired on or after October 1, 2013, notice must be provided within 14 days of the start of their employment.

Please note that there is no requirement that you provide health insurance to any of your employees.

The U.S. Department of Labor has two "model forms" available … one is for employers who do provide coverage, the other for employers who do not provide coverage. 

For employers that currently offer health insurance… The model form is available from the U.S. Department of Labor ... http://www.dol.gov/ebsa/pdf/FLSAwithplans.pdf.  Part B of the model form provides information on the coverage offered by the employer, and any limitations on coverage.  Be sure to fill in the contact information in Part A.  You should also check with your insurance carrier to determine if the coverage meets the minimum standards of the Affordable Care Act.

For employers that currently do not offer health insurance… The model form is available from the U.S. Department of Labor... http://www.dol.gov/ebsa/pdf/FLSAwithoutplans.pdf.  Part B of the model form provides employer contact information and the statement that this employer does not provide insurance coverage, but that coverage can be obtained through the Marketplace.
